Legal Heir Certificate in Kerala: Application Form, Village Officer Verification, Documents & Fees
What is a Legal Heir Certificate in Kerala?
When a family member or property owner passes away without leaving a registered Will, a Legal Heir Certificate (അനന്തരാവകാശ സർട്ടിഫിക്കറ്റ്) is the primary revenue document required to claim bank deposits, settle insurance policies, transfer land ownership (Pokkuvaravu), receive government employee family pension, or claim provident fund benefits.
In Kerala, the Legal Heir Certificate is issued by the Tahsildar of the respective Taluk after a thorough field inquiry conducted by the Village Officer.
Who are Recognized as Legal Heirs?
Under Indian Succession Law applicable to different personal laws, recognized Class-1 legal heirs typically include:
- Surviving Spouse (Wife / Husband)
- Biological and legally adopted Children (Sons and Daughters)
- Mother of the deceased
- Surviving parents (if no surviving spouse or children)
